It has already been explained that one who lifts a lost object for his fellow, his fellow has acquired it and he cannot retract. However, if he lifted it without specification and afterwards said that at the time of lifting he lifted it for his fellow, and afterwards while the object was still in his hand he said, "I was joking with you and in truth my intention was for myself," he is believed; since at the time of lifting he said nothing, and also that other person did not request that he acquire it on his behalf [Tur]. But if the other person requested that he lift and acquire it on his behalf—for example, one who was riding upon an animal and saw the lost object and said to his fellow, "Acquire this lost object for me," and he lifted it without specification—the rider has acquired it, even though it has not reached his hand. The one who lifted it is not believed to say, "I lifted it for myself," even while it is still in his hand; for since he lifted it via his request, if it were not his will to acquire it [for the rider], he should have said at the time of lifting, "I am lifting it for myself." And this is specifically when he said, "Acquire it for me," but if the rider said to him, "Give it to me," where the acquisition is not from the time of this person's lifting but rather from the time he delivers the object to him, and this person took it and lifted it without specification and afterwards said, "I have acquired it, for my intention was for myself," the one who took it has acquired it. For even if we were to say that the intention of the one lifting was for his fellow, nevertheless, he himself did not request that he acquire it on his behalf. But if he delivered it to the rider and afterwards said, "I acquired it first and lifted it for myself, and this fact that I delivered it to him, my intention was not to transfer ownership to him but only to show it to him," there is nothing in his words. For even if we were to say that it is so, that he lifted it for himself, nevertheless, we are witnesses that when he delivered it into his hand, he gave it to him as a complete gift, since previously the rider requested that he give it to him and he did so.
כבר נתבאר דהמגביה מציאה לחבירו קנה חבירו ואינו יכול לחזור בו אבל אם הגביה סתם ואח"כ אמר שבשעת הגבהה הגביה לחבירו ואח"כ בעוד החפץ בידו אמר ששחקתי בך ובאמת היה כוונתי לעצמי נאמן כיון שבשעת ההגבהה לא דיבר מאומה וגם אותו האחר לא בקשו לזכות בעדו [טור] אבל אם האחר בקשו להגביה ולזכות בעדו כגון מי שהיה רוכב ע"ג בהמה וראה את המציאה ואמר לחבירו זכה לי במציאה זו והוא הגביהה סתם קנה הרוכב ואע"פ שלא הגיעה לידו ואין המגביה נאמן לומר לעצמי הגבהתיה אפילו בעודה בידו דכיון דע"י בקשתו הגביה אם לא היה רצונו לזכות לא היה לו לומר בשעת ההגבהה לעצמי אני מגביה וזהו דוקא כשאמר זכה לי אבל אם הרוכב א"ל תנה לי דקנינו אינו משעת הגבהתו של זה אלא משעה שימסור לו החפץ וזה נטלה והגביה סתם ואח"כ אמר אני זכיתי בה דלעצמי היתה כוונתי זכה בה הנוטל דאפילו אם נאמר דכוונת המגביה היתה לחבירו מ"מ הרי הוא עצמו לא בקשו לזכות בעדו אבל אם מסרה להרוכב ואח"כ אמר אני זכיתי בה תחלה ולעצמי הגבהתיה וזה שמסרתי לו לא היתה כוונתי להקנותו אלא להראות לו אין בדבריו כלום דאף אם נאמר שכן הוא שהגביה לעצמו מ"מ אנן סהדי שכשמסרו לידו נתנה לו במתנה גמורה כיון שמקודם בקשו הרוכב ליתן לו והוא עשה כן:
